Minnesota families with LGBTQ+ spouses and parents have many of the same legal issues as those with opposite-sex partners, but they have some unique needs as well. At Mundahl Law, we are committed to serving LGBTQ+ individuals and their families with a variety of concerns, including family formation matters, estate planning for a growing or changing family, and divorce or dissolution. Located in Maple Grove, we are experienced in the broad spectrum of Minnesota family law issues, and dedicated to serving the needs of the LGBTQ+ community.
In 2013, the State of Minnesota passed a law officially recognizing same-sex marriage. In 2015, the Supreme Court of the United States ruled that the right to marriage exists regardless of sexual orientation. Although marriage equality is now the law of the land, not all family law attorneys understand the issues that affect LGBTQ+ individuals and their families.
At Mundahl Law, our LGBTQ+ family law attorney team is well-versed in LGBTQ+ legal matters. We assist individuals and families with a wide range of Minnesota family law matters, including:
Whatever your legal concerns, or those of your family, Mundahl Law will provide you the responsiveness, guidance, and advocacy you need. If we are unable for any reason to represent you, or believe we are not the best attorneys for your needs, we will help you find an attorney who is right for you.
The transgender and non-binary communities face a broad scope of legal issues when it comes to marriage, divorce, and adoption. While Minnesota is a “safe state” due to the passage of its trans refuge law in 2023, transgender individuals still often face unreasonable bias when it comes to family law issues. At Mundahl Law, we are committed to providing trusted representation during what may be one of the most vulnerable periods of your life.
Our family law attorneys are proficient in handling the following matters for clients who identify as transgender or non-binary:
We also provide legal counsel for matters concerning parental conflicts over the care and support of children who identify as transgender or non-binary. Our legal team can help provide you with the resources and advocacy you need to help ensure the best interests of your child are met.
Estate planning is crucial for LBGTQ+ individuals. Whether you are married to your partner or not, having the right estate planning documents in place can help ensure your wishes will be carried out in the future. These documents can also allow you to designate a person to make decisions on your behalf if you become incapacitated — who might not otherwise be legally recognized.
Our estate planning attorneys understand the estate planning needs of LGBTQ+ families. We can assist you with all aspects of estate planning, including the following:
We will work closely with you to create an estate plan that meets your objectives and provides you with the peace of mind you need.
At Mundahl Law, we understand that family law matters involving LGBTQ+ issues can be highly nuanced and legally complex. We use mediation, the collaborative process, and other forms of alternative dispute resolution (ADR) whenever possible to help you resolve your case amicably, efficiently, and cost-effectively.
Importantly, using a form of ADR can help you address your family’s unique needs — and assist you with finding creative solutions that might not be available in the courtroom. However, if resolving your case without judicial intervention is not a viable option, we are experienced litigators who will uphold your interests in the courtroom.
Whoever you are, however you identify, whatever your family looks like — we can help. We assist our clients with resolving family law disputes with as little hostility, and as much respect and dignity, as possible. Above all, we are dedicated to protecting our clients' rights and interests, and will advocate as vigorously as necessary to do so.
